Terms and conditions

This is a translation of our Dutch terms and conditions. If the versions differ, the Dutch version prevails.

1. Applicability
These terms and conditions apply to the use of the online theory platform AmadeosTheorie (the “Service”), including the website, the dashboard and all related content.

2. Ownership & intellectual property
AmadeosTheorie is owned by AmadeosTheorie and OptiByte.nl. OptiByte.nl handles development and technical support. All software, source code, UI/UX, exam questions, e-books, images, texts, database structures and other parts of the Service are protected by copyright and/or other rights.

3. Use of the Service
You receive a personal, non-transferable right to use the Service for your own preparation. Without written permission it is not allowed to:

• copy, distribute or resell the Service or its content;
• reuse content (such as exam questions/e-books) for commercial purposes;
• circumvent security measures, reverse engineer or decompile;
• scrape or index the Service automatically, or overload it (misuse).

4. Accounts & access
You are responsible for keeping your login details confidential and for all activity that takes place through your account. In case of suspected misuse we may restrict or end access.

5. Packages, duration and features
Access to parts of the Service may depend on the chosen package and its duration. The exact content (such as number of days/exams) is shown with the package during checkout.

6. Payment
Payments are processed by an external payment provider. A package becomes active after a successful payment. Any steps after a failed payment are explained during checkout.

7. Right of withdrawal and refunds
A package is digital content that is ready for you immediately after payment. With a distance purchase you normally have a 14-day cooling-off period (right of withdrawal). That is why, at checkout, we ask you to explicitly agree to immediate delivery and to confirm that you lose your right of withdrawal once your package is active. After a successful payment your package is activated immediately. From that moment, a refund is not possible. Did you pay but not receive access, or does your package not work as described? Then contact us at support@amadeostheorie.nl. We will solve it, and if that is not possible, we will refund you. Your statutory rights always remain in force.

8. Availability & changes
We aim for continuous availability but cannot guarantee it. We may adjust, improve or (temporarily) interrupt the Service for maintenance. We do this with as little disruption as possible.

9. Liability
The Service is intended as a practice and learning platform. We do not guarantee a pass result. To the extent permitted by law, our liability is limited to direct damage and to a maximum of the amount you paid for the package concerned.

How we process personal data is described in the privacy policy.

11. License & compliance
License and domain validation may apply to the software. See the license page for additional legal provisions.

12. Applicable law
These terms are governed by Dutch law. Disputes are submitted to the competent court.
